These Terms of Service (the "Terms") govern your use of the Keepsake app (the "Service") provided by Atelier Labs (the "Company," "we," "us" or "our"), and set out the rights, obligations and responsibilities of the Company and you.
(1) "Service" means all features we provide, including photo picking, entries, the Device Library, Entry Backup and the Safe Library. (2) "User" or "you" means anyone who agrees to these Terms and uses the Service. (3) "Account" means the information used to identify you, created when you sign in with Apple or Google. (4) "Device Library" means the feature that shows the photos you have picked, along with your notes, places and dates, using data stored only on your device. (5) "Entry Backup" means the feature that stores your entries (notes, places, dates and albums) on our servers and keeps them in sync across your devices while you are signed in. (6) "Safe Library" means the feature that stores the photos you add to Safe Albums on our servers, available to paid subscribers.
(1) These Terms apply to everyone who uses the Service. (2) We may amend these Terms to the extent permitted by applicable law. We will announce any amendment in the Service at least 7 days before it takes effect, or at least 30 days before if the change is unfavorable to you. (3) If you continue to use the Service after the amended Terms take effect, you are deemed to have accepted them. If you do not agree, you may stop using the Service and delete your account.
(1) The Device Library is free, works without signing in, and does not need an internet connection. (2) Entry Backup is free for signed-in users. Entries you created on your device before signing in are added to your account only if you choose them using "Upload device entries." (3) The Safe Library is available to paid subscribers and requires an internet connection. For each Safe Album, you can choose how photos are stored: "Original Quality" (keeps the original plus a viewing copy) or "Space Saver" (keeps only a viewing copy, 1600px on the longest side). (4) You must be at least 14 years old to create an account. (5) We may carry out maintenance, or suspend all or part of the Service temporarily, without prior notice in order to keep the Service running reliably.
(1) The Service does not make copies of your photos. Instead, it points to the originals in your device's photo library. If you delete a photo from your device's photo library, it will no longer appear in the Device Library, but its note, place and date will remain. (2) Photos in Safe Albums are shown from the copies stored on our servers. If you remove a photo from a Safe Album, we delete the stored copy unless the photo is also in another Safe Album. (3) The photo cleanup feature deletes the photos you confirm from your device's photo library. On iOS, deleted photos move to "Recently Deleted," where they stay for 30 days; if you use iCloud Photos, they are also deleted from your other devices. On Android 11 and later, they move to the device's trash. On Android 10 and earlier, deleted photos cannot be recovered. (4) We cannot recover photos that you have deleted from your device's photo library.
(1) The Safe Library is purchased as an in-app subscription through the Apple App Store or Google Play. The price and storage allowance are shown on the purchase screen. (2) Your subscription renews automatically on the same terms at the end of each period unless you cancel it. To avoid being charged, cancel in your device's subscription settings at least 24 hours before your next billing date. (3) Payments, refunds and cancellations are governed by the policies and procedures of the app store you purchased from. We cannot issue refunds directly for purchases made through an app store. (4) Deleting your account in the app does not cancel your app store subscription. (5) If we change the price, we will give advance notice in line with app store policies. If you do not agree to the new price, you may cancel before your next renewal.
(1) When your subscription ends (after any billing grace period offered by the app store has passed), you will no longer be able to upload new photos. Entry Backup and sync remain available as long as you are signed in. (2) For 30 days after your subscription ends, you can still view the photos in your Safe Library and save them to your device's photo library. We will send you an app notification when your subscription ends, 7 days before deletion and 1 day before deletion. (3) If you resubscribe within those 30 days, your stored photos carry on as before. (4) After 30 days, we delete all photos stored on our servers. Deleted photos cannot be restored. Your entries and albums remain in Entry Backup. (5) If you exceed your storage allowance, only new uploads are paused. Photos you have already stored are not deleted.
(1) You may not share your account with anyone else or use another person's account. (2) If you become aware that your account has been used without your permission or that its security has been compromised, you must notify us immediately. (3) You can delete your account at any time under [Settings > Account > Delete Account]. When you do, the entries, photos and account information stored on our servers are deleted immediately and cannot be restored. Entries you created on your device before signing in stay on your device.
(1) You own the intellectual property rights in the photos, notes and other content you add to the Service. (2) We store and process your content only as needed to provide the Service, such as backing up, restoring and syncing your entries and creating viewing copies of photos. We do not make your content public, use it for advertising or AI training, or share it with third parties. (3) We own the intellectual property rights in the Service itself, including its screens, design and software.
You must not: (1) store content on our servers that infringes the rights of others or violates the law; (2) use the Service for anything other than keeping your photos, such as distributing files or acting as storage for another service; (3) place an abnormal load on our servers, circumvent security measures, or attempt to access other users' data; (4) reverse engineer the Service or distribute modified versions of it; or (5) engage in any other conduct that violates applicable law. If we find that you have violated these rules, we may restrict your use of account features after notifying you. In urgent cases, we may restrict your use first and notify you afterwards.
(1) We may change or discontinue the Service for business, technical or legal reasons. (2) If we discontinue the account-based features, we will announce it in the Service at least 30 days in advance and make sure you can save your photos to your device during that time. Any remaining subscription period will be handled in accordance with app store policies and applicable law.
(1) We make reasonable efforts to keep the data stored on our servers safe. (2) We are not responsible for interruptions to the Service caused by events beyond our control, such as natural disasters, war or telecommunications failures. (3) Unless we acted intentionally or negligently, we are not responsible if: photos or entries that existed only on your device are lost because you deleted photos from your device's photo library or lost your device; you removed photos from a Safe Album or deleted your account; or photos were deleted because 30 days had passed since your subscription ended. (4) To the extent permitted by applicable law, we are not liable in connection with features we provide free of charge.
We protect your personal information in accordance with applicable law and our Privacy Policy. For details, please see our Privacy Policy.
(1) If a dispute arises in connection with your use of the Service, you may raise it with us. (2) Matters not covered by these Terms are governed by the laws of the Republic of Korea and general commercial practice. (3) The competent court for any lawsuit arising from your use of the Service will be determined in accordance with the Civil Procedure Act of the Republic of Korea.
